Prison inmate required to pay back child support

When a parent fails to make one or more required child support payment in Ballantyne, North Carolina, he or she is considered to be in arrears and may face penalties. These missed payments are typically expected to be made up regardless of the current situation.

A 47-year-old man recently tried to argue that because his daughter died, he should not have to make up the missed child support payments to his ex-wife. He was required to pay his ex-wife child support of $67 a week after the two divorced in 1990.

The man is currently serving a 60-year prison sentence for his 1997 conviction of murder and feticide. His daughter died in April 2006 in a house fire when she was 18 years old. In December 2012, his ex-wife received an income withholding order to pay for the child support arrearage.

Although the man tried to fight the ruling in an appeal, the court ruled that 55 percent of the money he earned in prison would be garnished in order to make up for his owed child support. The court said that even though the child was dead, the support arrearages were still owed. The man currently works around 37 hours a week in the prison laundry and makes 95 cents an hour.
