Man files motion in divorce case following death of wife

It is certainly no secret that divorces in Ballantyne, North Carolina can be both complicated and nasty. The reasons for this are varied. Couples that are divorcing often harbor feelings of discontentment and sometimes ill will toward each other. Many are concerned with protecting their own interests and ensuring that they receive a fair divorce settlement.

An impending divorce became even more complicated after the wife took her own life last year. The 38-year-old woman served three tours of duty as a naval reservist in Afghanistan and Iraq. After the second tour, she was diagnosed with post-traumatic stress disorder.

Two months before her suicide, the woman changed the beneficiary to her retirement and life insurance policies from her husband to her two girls, ages 10- and 13-years-old. If something happened to the girls, the woman’s boyfriend would receive the $500,000 instead.

The woman filed for divorce from her husband in September 2012 after 13 years of marriage. After the woman’s death, the divorce case was ended. The husband filed a motion in which he claimed that when his wife had rearranged the policies and beneficiaries, she violated a court order. He said the money would have been part of the divorce settlement. A judge denied his motion.
