Man faces jail time over child support mix-up

Child support is taken very seriously in North Carolina. When a parent who is ordered to pay child support does not fulfill his or her responsibilities, serious consequences can occur. However, for one parent, those consequences were realized even after he had paid his child support in full.

A portion of the man’s wages were being withheld every paycheck in order to be given to his ex-wife for child support payments. Unbeknownst to him, his employer was inexplicably withholding a different amount from his paycheck every week. This administrative error led to the man owing $3,000 in child support.

Although the man paid the $3,000 as soon as he found out about the error, he was still required to appear in court to answer for the late payments. The judge said he would be required to pay another $3,000 for his ex-wife’s lawyer’s fees.

As if that wasn’t bad enough, the judge also ordered the man to spend six months behind bars for not following a court-ordered schedule for picking up his child. Even when the man and his lawyer said they knew nothing of this schedule, the sentence remained.

This ruling flabbergasted the man and his attorney. The man feels like it is not in the best interest of his child since he will not be able to work and pay child support while he is in jail. Hopefully his lawyer’s plans to file an appeal will be successful and enable the man to continue to work and provide for his son the way he has been doing.
